These Terms of Service (“Terms”) govern your access to and use of the DrillerDB website, software applications, contractor directory, DepthMap subscription, interactive well map, mobile applications, APIs, and related products or services (collectively, the “Services”) provided by DrillerDB, LLC (“DrillerDB,” “we,” “us,” or “our”). By creating an account, claiming a contractor profile, purchasing a subscription, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.
DrillerDB provides software and data services for the water well industry, including:
These Terms form a binding agreement between you and DrillerDB and apply to free services, paid subscriptions, beta features, and any content or materials we make available.
You must be at least 18 years old and capable of entering into a legally binding contract to use the Services. If you use the Services on behalf of a business or organization, you represent that you have authority to bind that entity, and “you” includes both you and the entity.
You are responsible for maintaining accurate account information, safeguarding your login credentials, and all activity occurring under your account. Notify us immediately at support@drillerdb.com if you suspect unauthorized use.
DrillerDB offers multiple service tiers to meet different needs:
Any contractor can claim or create a business profile at no cost. The free tier includes:
Free profiles appear in search results but are not featured or prioritized. There is no time limit on the free tier.
Contractors can upgrade to a Priority Listing for enhanced visibility:
Priority Listing is available as a monthly ($49/month) or annual ($399/year) subscription. Contractors with an active DrillerDB software subscription (Basic or Enterprise) receive Priority Listing at no additional cost.
A map-focused subscription providing access to:
The DepthMap plan does not include project management features such as proposals, scheduling, invoicing, or QuickBooks integration.
A comprehensive project management subscription including:
Basic plan includes a 14-day free trial for new subscribers. Pricing starts at $129/month or $1,188/year, plus per-user fees for additional team members.
The full-featured subscription including everything in Basic, plus:
Enterprise plan includes a 14-day free trial for new subscribers. Pricing starts at $349/month or $3,588/year, plus per-user fees for additional team members.
Basic and Enterprise subscriptions include per-user fees for active team members beyond the initial account. Current per-user pricing is $5/month per additional user.
By submitting your payment details, you authorize DrillerDB and its payment processor (currently Stripe) to charge the applicable fees, plus any taxes, on a recurring basis until you cancel. Unless otherwise stated, subscriptions renew automatically each billing cycle at the prevailing rate.
You can cancel at any time through your account settings, the Stripe customer portal, or by contacting support at least 24 hours before the next renewal. Cancellation prevents future charges but does not entitle you to a refund for the current term unless Section 5 applies or required by law.
You agree to keep payment details current and to pay all amounts due. We may suspend or terminate access for unpaid balances. Chargebacks or disputes filed with a payment provider may result in immediate account suspension.
IMPORTANT: YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW. By subscribing to any paid DrillerDB plan, you acknowledge and agree to the following automatic renewal terms:
For California Residents: You may cancel your subscription at any time prior to midnight of the third business day following the date you subscribed. If you subscribed for a term longer than one month, you may cancel at any time by contacting us. Upon cancellation, you will receive a prorated refund for the unused portion of your subscription if required by California law.
For New York Residents: Your subscription will continue until you cancel. You have the right to cancel at any time by following the cancellation methods described above.
For Illinois Residents: Automatic renewal will be disclosed clearly at the time of purchase, and you will receive reminder notices before each renewal as required by the Illinois Automatic Contract Renewal Act.
From time to time we may offer free previews, promotional pricing, or introductory trials. Promotional terms apply only as stated at enrollment. Unless expressly noted, promotional subscriptions convert to a standard paid plan at the end of the trial and begin auto-renewing.
14-Day Trial: Basic and Enterprise plans include a 14-day free trial for first-time subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
30-Day Money-Back Guarantee: First-time DepthMap, Basic, and Enterprise subscribers are eligible for a 30-day money-back guarantee. To request a refund, email support@drillerdb.com within 30 days of initial purchase. Refunds are granted for the most recent term only and may take up to 10 business days to process.
Priority Listing Refunds: Priority Listing (Marketing) subscriptions may be canceled at any time. No partial refunds are provided for canceled monthly or annual subscriptions.
All other fees are non-refundable except where required by law.
The DrillerDB Contractor Directory allows well owners to find and contact drilling contractors. By claiming or creating a profile, you agree to the following:
DrillerDB reserves the right to remove or modify profiles that violate these Terms, contain inaccurate information, or receive excessive complaints.
Subject to these Terms, DrillerDB grants you a limited, revocable, non-exclusive, non-transferable license to access the Services and view, download, or export well and geology data for your internal business or personal use only.

We may monitor usage for compliance and suspend or terminate access for violations.
You retain ownership of any content, well records, customer data, or business information you upload. You grant DrillerDB a non-exclusive, worldwide license to store, process, display, and transmit that content solely to provide the Services.
For public-facing content (such as contractor profiles, photos, and review responses), you grant us a license to display this content publicly in our directory and in marketing materials promoting the directory.
You are responsible for:

The Services integrate with various third-party services and data sources:
DrillerDB does not guarantee the accuracy, completeness, or availability of third-party data. External links and integrations are governed by their own terms and privacy policies. We are not responsible for third-party acts, omissions, or service outages.
When you connect third-party accounts (such as QuickBooks), you authorize data exchange between DrillerDB and that service as described in our Privacy Policy.
We endeavor to maintain high uptime but do not guarantee the Services will be uninterrupted or error-free. Scheduled maintenance, network outages, or updates may affect availability.
Support requests can be submitted via support@drillerdb.com. Enterprise subscribers receive priority support with faster response times.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” DRILLERDB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WELL DATA, GEOLOGICAL INFORMATION, MAP OUTPUTS, AND CONTRACTOR LISTINGS ARE PROVIDED FOR REFERENCE ONLY AND SHOULD NOT REPLACE STATE RECORDS, PROFESSIONAL ENGINEERING JUDGMENT, OR INDEPENDENT VERIFICATION. YOU ASSUME ALL RISK FOR RELIANCE ON THE INFORMATION.
DRILLERDB DOES NOT ENDORSE, GUARANTEE, OR VERIFY THE QUALIFICATIONS, WORK QUALITY, OR REPRESENTATIONS OF ANY CONTRACTOR LISTED IN OUR DIRECTORY. WE RECOMMEND VERIFYING LICENSES, INSURANCE, AND REFERENCES BEFORE HIRING ANY CONTRACTOR.
TO THE FULLEST EXTENT PERMITTED BY LAW, DRILLERDB WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
DRILLERDB IS NOT LIABLE FOR ANY DISPUTES, DAMAGES, OR CLAIMS ARISING FROM INTERACTIONS BETWEEN WELL OWNERS AND CONTRACTORS, INCLUDING WORK QUALITY, PRICING, OR CONTRACTUAL DISPUTES.
EXCEPTIONS: THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO: (1) LIABILITY ARISING FROM DRILLERDB'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT; (2) DRILLERDB'S INDEMNIFICATION OBLIGATIONS UNDER SECTION 14; (3) EITHER PARTY'S BREACH OF CONFIDENTIALITY OBLIGATIONS; (4) EITHER PARTY'S INFRINGEMENT OF THE OTHER'S INTELLECTUAL PROPERTY RIGHTS; OR (5) LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless DrillerDB and its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
DrillerDB agrees to indemnify, defend, and hold harmless you and your officers, directors, employees, and agents from any third-party claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
The indemnified party must: (a) promptly notify the indemnifying party of any claim; (b) give the indemnifying party sole control of the defense and settlement (provided that no settlement may impose obligations on the indemnified party without consent); and (c) provide reasonable cooperation at the indemnifying party's expense. The indemnified party may participate in the defense at its own expense.
We may suspend or terminate your access at any time for conduct that violates these Terms or applicable law, or to protect the Services and other users. Reasons for suspension or termination include but are not limited to:
You may terminate by canceling your subscription through your account settings or by contacting support. For free Contractor Dashboard accounts, you may request account deletion at any time.
Upon termination:
Sections that by their nature should survive (including payment obligations, intellectual property rights, disclaimers, limits of liability, and indemnities) will survive termination.
These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-law principles. You agree to the personal jurisdiction of, and exclusive venue in, the state and federal courts located in Wisconsin for any disputes not subject to arbitration.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
Before initiating any formal dispute resolution proceeding, you agree to contact DrillerDB and attempt to resolve any dispute informally within 60 days. Send dispute notices to support@drillerdb.com with the subject line “Dispute Notice” and include: (a) your name and contact information; (b) a description of the dispute; and (c) the relief you are seeking. DrillerDB will attempt to resolve the dispute through good-faith negotiations.
If we cannot resolve the dispute informally within 60 days, you and DrillerDB agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved exclusively through binding arbitration, rather than in court, except that either party may bring individual claims in small claims court if they qualify.
Arbitration will be administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules and, where appropriate, the Supplementary Procedures for Consumer Related Disputes. The arbitration will be conducted by a single arbitrator in the English language in the State of Wisconsin, or at another mutually agreed location. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Arbitration Fees: If you are an individual (not a business entity) and your claim is for $10,000 or less, DrillerDB will pay all arbitration filing and hearing fees. For all other claims, the parties will share arbitration costs as determined by the AAA rules, unless the arbitrator determines that a party's claims are frivolous or brought in bad faith.
YOU AND DRILLERDB AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and the dispute shall proceed in court.
Notwithstanding the above, either party may:
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to support@drillerdb.com with the subject line “Arbitration Opt-Out” that includes your name, email address, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, you may pursue claims in court, subject to the governing law and venue provisions in Section 16. Opting out will not affect any other aspect of these Terms.
This arbitration agreement will survive termination of your account or these Terms.
We may modify the Services, pricing, or these Terms at any time. Material changes will be posted on this page with an updated revision date. For significant changes affecting your subscription or rights, we will provide notice via email or in-app notification at least 30 days before the changes take effect.
Continued use after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Services and cancel any subscriptions before the changes take effect.
